Former adviser suggests KPK to file cassation

REPUBLIKA.CO.ID, JAKARTA -- Former adviser to the Corruption Eradication Commission (KPK), Abdullah Hehamahua suggested that KPK to file cassation of the defeat in a pretrial hearing of Ilham Arief Sirajuddin. It was considered appropriate legal remedy to prove that the determination of suspect former mayor of Makassar is based on strong evidence.

"I think it is better for to file cassation," said Hehamahua as confirmed via cell phone, on Wednesday, May 13.

He argued that the cause of the defeat of the anti-corruption institutions in the pretrial hearing due to of two things.

First, he said, the pretrial ruling by a judge at the South Jakarta District Court were less precise and controversy as the pretrial lawsuit verdict of Commissioner General Budi Gunawan.

However, Hehamahua was reluctant to comment on the content of the judge's decision. He claimed to have not read the full reasons of single judge, Yuningtyas Upiek, were in favor of Ilham.

"I have not been able to give a final opinion on this matter," he said.

Second, continued Hehamahua, there was negligence in the process of inquiry and investigation conducted by KPK.

As known, the South Jakarta District Court granted Ilham Arief Sirajuddin pretrial. Determination of the suspect by the KPK rated invalid because KPK did not have sufficient two evidences in determining the suspect. As a result, warrant investigation (sprindik) for Ilham issued by KPK on May 2, 2014 became invalid.
