REPUBLIKA.CO.ID, YOGYAKARTA -- President Joko Widodo should issue a government regulation in lieu of law on the granting of immunity rights to commissioners of the Corruption Eradication Commission (KPK), an administrative law expert said.

"We hope that the President will issue a government regulation in lieu of law to give immunity rights to the Corruption Eradication Commission (KPK) including other corruption eradication officers in Indonesia," Zainal Arifin Mochtar of the Yogyakarta-based Gadjah Mada University (UGM) said here on Sunday (25/1).

Corruption eradication officers, particularly those of KPK deserve to receive special legal treatment because they are susceptible to the criminalization efforts, he said.

He said KPK commissioners and employees should receive the same treatment as the Indonesian ombudsman. Under the law, no ombudsman members can be prosecuted and put in custody.

Article 37 paragraph 3 of the United Convention Against Corruption (UNAC) stipulates that the state must consider "immunity against prosecution" for those who have contributed to substantial cooperation in justice collaborator, he said.

Instead, anti-corruption officers must deserve to receive special treatment, he said.

After all, the government regulation in lieu of law on immunity can be excepted if the parties are found committing a criminal offense, he said.
