Courts orders KPK to name another Bank Century suspects

Court orders KPK to name Budiono, Muliaman, and Raden as suspect on Century case.

REPUBLIKA.CO.ID, JAKARTA --  Sole judge of South Jakarta District Court, Effendi Mukhtar has ordered the Corruption Eradication Commission (KPK) to continue investigating the case of Bank Century. In the verdict numbered 24 / Pid.Pra / 2018 / PN.Jkt.sel., the Judge granted the pre-trial petition filed by the Anti-Corruption Society (MAKI). 

Spokesperson of South Jakarta District Court Achmad Guntur explained that KPK was ordered to name a number of former Bank Indonesia officials, including former BI governor Boediono, as suspect.

The result of the decision to order the requested party, ie KPK, to conduct further legal process in accordance with the provisions of law and regulations applicable to alleged corruption crime of Bank Century.

"In the form of conducting an investigation and assigning suspects to Boediono, Muliaman D. Hadad, Raden Pardede and others as embodied in the indictment on behalf of defendant Budi Mulya," Guntur explained in Jakarta, Wednesday, (April 11). 

KPK was also asked to delegate the tasks to the police and prosecutors if the anti corruption institution not to continue to investigate the case. The next trial to be conducted at the Corruption Court, Central Jakarta. Guntur declined to comment whether the KPK is obliged to undergo a pretrial court ruling in South Jakarta District Court. According to him, it was KPK's authority.

Guntur said in the execution there was no mechanism that regulates the time limit or obligation of KPK to comply with this decision.  "All returned to law enforcement whether it could be done or not," he said. 

He explained that every law enforcement has measure and evidence to conduct an investigation. He also assigned this decision whether to be followed up by KPK or supervised to other law enforcers such as Police and Attorney General.

Meanwhile, KPK said they would study the decision of South Jakarta District Court. "We respect the court's decision. KPK will study the verdict and see how far it can be implemented because the verdict is relatively new in a number of pretrial decisions," said KPK Spokesperson Febri Diansyah in Jakarta.

Boediono, as the governor of Bank Indonesia in 2008, approved a loan of Rp 689.3 billion and paved the way for Bank Century to receive a temporary capital injection of Rp 6.7 trillion from the Deposit Insurance Agency. He has been accused of approving the bailout despite knowing that Century did not qualify for the help.
