'KPK investigators cannot be from TNI'

REPUBLIKA.CO.ID, JAKARTA -- Constitutional Law Researchers of Synergy of Community for Indonesian Democracy (Sigma), M Imam Nasef, assessed that the recruitment of Indonesia military (TNI) personnel as the Corruption Eradication Commission (KPK) investigators is not appropriate. Beside that it does not comply with work rules, the recruitment will likely rise a conflict of interest.

"As is known, TNI is in charge of defending, protecting, and maintaining the integrity of the state, while the task as an investigator is the duty of law enforcement. The task was not included in the work rules of the TNI, " he said when contacted by ROL, on Thursday, May 7.

Nasef said that KPK investigators could only be taken from the police personnel. This, he said, was ruled in the law (UU) of KPK. "Beside, the appointment of a military investigator may present a conflict of interest," added Nasef.

Furthermore, Nasef explained that military body had investigation function. The function is especially held by military courts.

"Still, there are fundamental differences. Military courts handle military cases, while investigators can handle the society (civil) cases. If the case id forced, these differences could interfere with the investigation process," he concluded.

As is known, the discourse of military recruitment in KPK is developed after the KPK investigators, Novel Baswedan arrested by police last week. Meanwhile, the military commander, Gen. Moeldoko admitted it had enthused directly by the Commission to fill the posts in the Commission. The post of secretary general of the Commission offered to members of the military.
