Jakarta High Court rejects KPK's appeal against Setnov

REPUBLIKA.CO.ID, JAKARTA -- DKI Jakarta High Court has reached its decision on an appeal to the case of e-ID card graft case. 

The judges granted part of Corruption Eradication Commission (KPK)'s appeal with raising the replacement punishment of two defendants, namely Irman and Sugiharto. Both of them are former officials of the Ministry of Home Affairs.

The judges assessed, Irman and Sugiharto are main perpetrators. Therefore, the court rejected the KPK's prosecutors appeal of the involvement of House speaker Setya Novanto (Setnov) in the e-ID card corruption case.

"In our opinion as panel of the judges of the High Court, the objections of KPK's prosecutors contained in their memory point a to c are unreasonable to be considered. Meanwhile, we have considered objections stated in point d and e where the defendants get additional sentence in a form of paying the replacement money," head of the judge's panel said on DKI Jakarta High Court, on Wednesday (November 11).

In their memory of appeal, the KPK's prosecutors stated: 

a. Stated that Setya Novanto and Drajat Wisnu Setyawan are friends of the participants.

b. Declare the names mentioned above as the beneficiary because of the defendant's actions.

c. Declare not to consider the withdrawl of investigation report of Miryam S. Haryani and continue to use the information given by Miryam S. Haryani to the investigators as valid evidence.

"Considering that based on the facts of the trial, it can be concluded that the two defendants (Irman and Sugiharto) are the main actors who have significant role in the budget planning stage, the auction stage of work and the implementation stage of the e-ID project," said the judges.

In the verdict, the judges stated the two defendants acted as main actors in a quo case. Therefore, the defendant were not entitled to special treatment in the form of waivers of sentence.

The judges believed, Iman and Sugiharto has the same active role in the graft case, so they would share the same term of imprisonment.
