Law enforcers must follow up BPK’s finding: Mahfud MD

REPUBLIKA.CO.ID, JAKARTA -- Police and Attorneys should take a follow up action on any deviation of Corruption Eradication Commission (KPK) and Indonesian Corruption Watch (ICW), as reported by the Director of Center of Independent Studies on Public Policies Professor Romli Atmasasmita, said an Expert on Constitutional Law Mahfud MD.

“If Indonesian Auditory Board (BPK) had a finding, the law enforcers must follow it up,” said Mahfud to Republika.co.id on Saturday (July 1).

The police and attorneys had an authority to follow up BPK’s finding as KPK was a state institution. The finding on ICW might also be processed by the police as it was a general crime. BPK might be presented in the legal process.

“It is easy as BPK will be asked for information,” said the Former Chairman of Constitutional Court.

Mahfud said any grants should follow the procedure and the existing rules. At least, there should be a notification to the government. It was not only implemented to KPK and ICW, but also to any community’s organization and political party.

The House of Representatives (DPR) might also hold KPK and ICW’s accountability related to BPK’s finding. It was an evaluation for the anti-graft agencies.

However, the initial step should not be taken by holding an inquiry rights. DPR might only call the leader of the institution. “Only calls (the chairman). If it is not satisfying, report them. Encourage the attorney and police,” he said.

Previously, Romli shared some twits on his personal Twitter account @rajasundawiwaha. He told an analysis on KPK and ICW’s performance. He said both institutions had deviated.

All the data shared referred to his book titled ‘the Other Side of KPK and anti-Corruption Agencies: fact and analysis’. The data were based on BPK report to KPK and financial audit of ICW by Yanuar accounting firm. Romli showed a number of foreign funds and grants pouring the institutions.

He said there were some violation of Law on Grants did by KPK and ICW. ICW denied the accusation. Chairman of ICW Adnan Topan said it was weird that Romli revealed the data after the inquiry right was issued by DPR.

"If it is said to be not transparent, it is wrong. Our financial reports are always being published on the website. And the data from the book can be seen at our website,” he said.
