Revocation of Perda reflects poor qiality of legislation in regions

REPUBLIKA.CO.ID, JAKARTA -- Research Director of Setara Institute Ismail Hasani said the revocation of 3,143 regional regulations (Perda) reflected poor quality of legislation in the regions.

The mechanism also failed to work to prevent the regional administrations from issuing regulations beyond their authority, Ismail said.

President Joko Widodo (Jokowi) announced on Monday that the Home Affairs Ministry had cancelled 3,143 problematic regional regulations.

The regulations were considered to be restrictive causing a drag on economic development as they hampered licensing process, discouraging investment and they were in contrary to the country's law.

Ismail said the abolition of Perda should push for reform in the legislation mechanism in the regions.

In addition, a mechanism is needed to guarantee consistency between Perda and the state Constitution and ideology Pancasila, he said.

"These two factors are a real requirement in the system of drafting law regulations in Indonesia," he said.

According to Setara Institute, the number of Perda abolished was the largest ever since the implementation of regional autonomy.

The central government abolished 2,246 regional regulations from 2002 to 2009 and 1,501 regional regulations in from 2010 to 2014. From November 2015 to May 2016 , the government cancelled 139 more regional regulations.

Altogether with the new cancellation, the central government has cancelled 7,029 regional regulations since 2002.
