REPUBLIKA.CO.ID, JAKARTA -- Home Affairs Minister, Tjahjo Kumolo stated that he could refuse the resignation submission of the regional head ahead of simultaneous local elections. According to him, Home Affairs Minister could reject the resignation of the regional head if parliament did not give consent.
"We could (reject). Moreover, the parliament did not agree, so be it," said Tjahjo in Vice President's office, Jakarta, on Thursday, June 18.
However, continued Tjahjo, if Parliament gave its approval to the filing of the resignation, Home Affairs Ministry must approve the submission. During this time, he explained, the regional head was submitting a resignation without mention the reason. Tjahjo also exemplified the East Kutai Regent Isran Noor who resigned without reason.
Currently, there were three heads or deputy heads of regional that apply for the retreat. Namely, the Mayor of Pekalongan Bashir Ahmad, Bupati Ogan Ilir Mawardi Yahya, and Deputy Mayor of Sibolga Marudut Situmorang. Home Affairs Ministry also asked for the reason of filing the resignation.
"Although it was not explicit but from the sources that I have to pending it first, I'll be wait the information for MK," added Tjahjo.
According to Tjahjo, the submission of resignation and even not in accordance with the political ethics that should serve for five years. "Unless he remains incapacitated. He did not remains absent but he had a purpose, it was not good to sacrifice the governance. It indeed there are not sanctions," he said.
As is known, a number of heads and deputy heads of regions intended to resign in order to smooth the intention of his family in order to advance in the local elections. This step was also assessed done to deal with the legislation.
The law that Article 1 point 6 of Law Number 8 of 2015 concerning Election of governors, regents, and the mayor that mentioned the candidates for the head/deputy head of the region should not have any conflict of interest with the incumbent.
In explanation of the article mentioned, it means the conflict of interest relates the incumbent related by blood, marriage bond and/or lineage one level straight up, down, sideways with the incumbent, i.e father, mother, in-laws, uncles, aunts, brothers, sisters, son, daughter, in-law. Unless, has passed the break one more term.
