Sigma: Military personnel not suitable for KPK investogators

REPUBLIKA.CO.ID, JAKARTA -- The Community Synergy for Indonesian Democracy (Sigma) said military officers may not be employed as investigators of the Corruption Eradication Commission (KPK).

Sigma researcher Muhammad Imam Nasef said criminal investigation is not in line with the military duty.

"First it is not in line with the basic duty of the military as regulated by the Constitution. The 1945 Constitution clearly rules that military is state apparatuses to defend, protect and maintain the integrity and sovereignty of the nation," Imam Nasef pointed out here on Thursday.

Nasef was commenting on KPK raising the idea of recruiting investigators from the military to help uproot corruption in the country beset by rampant corruption.

Criminal investigations as part of the duty of law enforcement is not included in the basic duty of the military, he added.

"Second, investigators from the military are not allowed by the Law No. 30 of 2002 on KPK. The law allows only KPK to recruit investigators from police," he said.

Investigators from the military would not rule out conflict of interest, he said, adding one of the reasons for the idea of recruiting investigators from the military is fear of conflict of interest.

Meanwhile, lawmaker from the Commission I of the Parliament Mahfudz Siddiq rejected the idea of KPK recruiting investigators from the military.

He said the idea is against the law.

"The basic duty of the military is not law enforcement," he said on Thursday.

KPK made a big mistake if the anti graft agency KPK asks for investigators from the military, he said , adding similarly the military was wrong if it offered or accepted such as request from KPK.

He said the Commission I would raise the question to the military in the next working meeting.

"KPK should be careful in bringing in investigators from both police and the military. They could be set against each other," he said.

Earlier the military headquarters said it is ready to provide investigators for KPK.

Maj.Gen Fuad Basya, head of the military information center, said the military has capable officers to meet the KPK requirement.

The military is ready to provide its officers if needed by KPK both as investigators, prosecutors and judges.
