REPUBLIKA.CO.ID, JAKARTA – Government could denounce the shooting and the allegation of organ theft of three Indonesian workers in Malaysia to United Nations (UN) as it is classified as human rights violation. 

“The shooting on three Indonesian workers is the violation of human rights. Government could denounce it and bring the case to the UN,” the Deputy Speaker of House of Representatives, Pramono Anung, said on Wednesday. Government should take political steps to investigate the case.

Injustice is often the cause of harassment towards Indonesian workers. Unlike Malaysia, Anung said, Indonesia had ratified laws on labor and worker.  

The Commissioner of National Commission on Violence against Women, Agustinus Supriyanto, said the tragedy could recur on other migrants. Malaysia should have told Indonesian Embassy about the case. He criticized, the article 5 and 37 of Vienna Convention on Consular Relations are not applied well as the article requires the receiving States to inform without delay the consular post of the sending States.

The Commission recommended Indonesia and Malaysia to create bilateral agreement on mechanism of Mandatory Consular Notification (MCN) contained the reciprocal obligation to inform the foreign citizen condition to consular post without delay.

Malaysia has not given any official statement over the case so far. Meanwhile, the Commission IX of House of Representatives for health and labors urged the Ministry of Labor to re-impose the moratorium on labor export to Malaysia. “We will urge the moratorium,” the Deputy Chairman of Commission IX, Irgan Chairul Mahfiz, said on Thursday.
