Judge Kusno drops Setya Novanto pretrial motion

REPUBLIKA.CO.ID, JAKARTA -- The sole judge Kusno at South Jakarta Dictrict Court has decided to drop Setya Novanto pretrial motion that challanged Corruption Eradication Commission (KPK) for naming him as suspect in e-ID card procurement graft case. 

The decision was based on several considerations.

"The pretrial judge has observed the evidence of letter submitted by the petitioner, namely evidences T64 A and T 64B, that the main case on behalf of the applicant has been transfered and the hearing has been set on December 13, 2017," Kusno at South Jakarta District Court on Thursday (December 14). 

Kuso also has listened carefully the taping of inaugural session in the Corruption Court as evidence. The hearing was open for public.

"Clearly, the chief of panel judge has examined and opened the trial with the defendant namely Setya Novanto," Kusno explained.

In addition, Kusno also considered the obliged timing to drop pretrial suit. He referred to Article 82 paragraph (1) sub-paragraph d of the Criminal Procedure Code and the decision of the Constitutional Court Number 102 / PUU-XIII / 2015.

"Whereas the provision of Article 82 Paragraph (1) Sub-Paragraph d of the Criminal Procedure Code stipulates that in a case that already begun to be examined by the District Court, while the case regarding pretrial motion has not been completed, the request shall be terminated," said Kusno.

against Corruption Eradication Commission (KPK) for alleged violation to the verdict of South Jakarta District Court decided by Judge Cepi Iskandar on September 29. 

Novanto filed the second pretrial suit as he believed KPK has lost its legitimation to investigate him in e-ID graft case following judge Cepi Iskandar of South Jakarta District Court's verdict that invalid his status as suspect on September 29.

KPK named Novanto a suspect in e-ID case in July. He allegedly played a key role in a plan to swindle funds earmarked for the project and the act contributed to an estimated Rp 2.3 million in state losses.

Although Novanto has cleared his name by winning pretrial motion, KPK continue to pursuing him.

KPK started new investigation and renamed Novanto as suspect on October 31.
