REPUBLIKA.CO.ID, JAKARTA -- Director of Center for the Study of Pancasila and Constitution (Puskapsi) Law Faculty at Jember University, Bayu Dwi Anggono said Setya Novanto (Setnov) showed his incompetence to understand Law No. 17/2014 of MPR, DPR, DPD and DPRD as well as the development of state administration after Court Decision 2015, Article 245 MD3 Law.

According to Bayu, the written permission from Court of Honor Council (MKD) has been replaced with written permission from President through the Constitutional Court (MK) decision. However, MK stated if president did not respond for more than 30 days since application received, the summon from investigators still can be done.

"It means the written permission from president can't be the reason to not attend a summon from investigators," Bayu said on Monday (November 6).

Bayu stressed, president has to give written permission only to members of House of Representative who allegedly committed crimes. Thus, those who get summon as witness in criminal case certainly does not require written permission from the President to testify.

"So the members of House of Representatives can't refuse to attend the summon from authorities as witness," Bayu added.

That day, Setnov was scheduled to be examined as a witness for the defendant Anang Sugiana Sudihardjo (ASS), the director of Quadra Solution, in e-ID card graft case.  

According to KPK, the institution has received a letter from General Secretariat at Board of Experts House of Representatives. They said Setnov would not attend KPK summon as witness, except there is permission from president.
