REPUBLIKA.CO.ID, JAKARTA -- Former commissioner of the Corruption Eradication Commission (KPK) Erry Riyana Hardjapamekas has suggested that Commr. Gen. Budi Gunawan should withdraw his candidacy for national police chief as he is a graft suspect now.
Erry expressed confidence here on Thursday that Commr. Gen. Budi Gunawan as law enforcer will respect legal processes and act as a gentleman.
"I am sure that as a law enforcer, he (Budi Gunawana) will act as a gentleman. I think if he resigns (as police chief candidate), he will look elegant," Erry stated.
Thus, Budi Gunawan can prove himself as an officer and a good citizen and respect the rule of law and its processes, he explained.
According to Erry, if in the future KPK detains Commr. Gen. Budi Gunawan, President Joko Widodo should be firm in his commitment to law enforcement and corruption eradication and cancel Budi's candidacy for Police Chief.
"The President should also propose new names for the post of Police Chief; officers who have excellent integrity as proven by inputs from relevant agencies such as the Advisory Council office for high ranking officials, National Police Commission, the Financial Analysis and Transactions Reporting Center, and KPK," Erry pointed out.
On Thursday (Jan 22), the "Salam 2 Jari" volunteers, Pukat UGM, Pusako Unand, Legal Aid Foundation, Increase Institute, and the Indonesian Transparency Society extended their full support to KPK for handling the alleged gratification case involving Budi Gunawan.
Commr. Gen. Budi Gunawan, the sole candidate for Police Chief, has been named in a corruption case for allegedly receiving bribes through suspicious transactions, KPK Chairman Abraham Samad said here Tuesday (Jan 13).
"Commissioner General BG (Budi Gunawan) has been named suspect for allegedly receiving commitments when he headed the Police Headquarters' Career Planning Bureau in 2003-2006 and other posts in the police," he noted.
According to Abraham Samad, Budi Gunawan allegedly violated Article 12 (A/B); Article 5 (2); and Article 11 or 12, (B), of Law No.31/1999 juncto Law No.20/2001 on corruption eradication juncto Article 55 (1) of Criminal Code.
The articles regulate that no civil servant or state official should receive gratifications or commitments from any party or individual who is related to a civil servant or holds a state official's post.
Budi Gunawan can get life imprisonment or four to 20 years in jail and a fine of at least Rp200 million (Rp1 billion) if he is found guilty of violating the articles, Samad stated.
President Jokowi issued two decrees on Friday (January 16): one dismissing Gen. Sutarman as national police chief and the other appointing Deputy Police Chief Commr. Gen. Badrodin Haiti as acting national police chief.
The decision was taken after Commr. Gen. Budi Gunawan, even after receiving Parliament's approval, was named a graft suspect by KPK.
