President yet to decide stance on Budi Gunawan

REPUBLIKA.CO.ID, JAKARTA -- President Joko Widodo has yet to determine his stance on the appointment of the candidate for Police Chief Commissioner, General Budi Gunawan, who has been named suspect in a corruption case.

"The President still sees the dynamics of law in Corruption Eradication Commission (KPK) and in Parliament. We will update our information with every development," Secretary of State Pratikno said here on Wednesday afternoon.

Meanwhile, Cabinet Secretary Andi Widjajanto remarked that President Joko Widodo has been concerned about legal and political processes related to Budi Gunawan.

"The President is closely observing two processes: the political process in Parliament and the legal process in the anti-graft body," he emphasized.

According to him, the President has been seeking a balance between those two processes so that he can make a decision as soon as possible.

"There has been no presidential directive on Budi Gunawan," he noted.

Moreover, he affirmed, the President respects the importance of law enforcement, so he has not sought the advice of the KPK.

"The President appreciates and respects the independence of law enforcement bodies in these cases. Although General Budi Gunawan has been named suspect in a corruption case, the President has stayed away from interfering so as to ensure smooth law enforcement," Andi pointed out.

Earlier, on Tuesday, KPK Chairman Abraham Samad said here that the sole candidate for Police Chief Commissioner, General Budi Gunawan, has been named suspect in a corruption case for allegedly receiving bribes through a suspicious transaction.

Budi Gunawan allegedly violated Article 12 (A/B); Article 5 (2); and Article 11 or 12, (B), of Law No.31/1999 juncto Law No.20/2001 on corruption eradication juncto Article 55 (1) of Criminal Code.

The articles regulate that no civil servant or state official should receive gratifications or commitments from any party or individual who is related to a civil servant or holds a state official's post.

Budi Gunawan can get life imprisonment or four to 20 years in jail and a fine of at least Rp200 million (Rp1 billion) if he is found guilty of violating the articles, Samad stated.

He, however, refused to reveal Budi Gunawan's bank balance.

Investigators with the anti-graft body have been examining Budi Gunawan's track record as a state official since July 2014. They got two credible evidences that helped them further investigate the case on January 12, 2015, Samad revealed.
