REPUBLIKA.CO.ID, JAKARTA -- The House of Representatives (DPR) Deputy Speaker Fadli Zon praised the Law and Human Rights Ministry's decision on the internal conflict of the Golkar Party, urging the party's internal mechanism to handle it.
"If the Law and Human Rights Ministry has urged the party to resolve the conflict through the party's internal mechanism, it is in line with the law," Fadli Zon affirmed here on Tuesday (16/12).
Fadli remarked that the political party's affairs were the internal matter of the party because according to Act No. 2 of 2011 on Political Parties, the government cannot intervene in the internal problems of the party.
According to him, the party's internal problems should be resolved through the party's court, and thus, the government can merely take administrative action.
"If the problems are resolved in the court then it is only an administrative action. The government cannot take sides with any single party. The party's court will resolve the internal conflict," he noted.
He remarked that the existence of a party court should be in line with the party's constitution that was AD/ART (rules of association). According to him, a National Conference or Congress should be held in accordance with the procedures outlined in the party's constitution.
"Congress or National Conference is the highest forum in each political party. They must have a mandate from the Regional Representative Council (DPD) and the Branch Representative Council (DPC). Each political party has a system like that," he emphasized.
The Law and Human Rights Ministry concluded that the issue of dualism within the Golkar leadership was an internal matter of the party, Law and Human Rights Minister Yasonna Laoly stated.
Yasonna said the decision was taken after considering all aspects such as juridical, facts, and documents.
"When we take into consideration all aspects such as juridical, facts and documents, we conclude that there is still a dispute and the ministry should not be allowed to intervene in the decision-making process," Yasonna emphasized.
He stated that Golkar should resolve its internal problem, and the Law and Human Rights Ministry could not make a decision regarding the issue of dualism in the party's leadership.
