Bareskrim stops Viktor case due to Parliamentary immunity

REPUBLIKA.CO.ID, JAKARTA -- National Police's Criminal Investigation Agency (Bareskrim) decided not to continue the case of hate speech of Viktor Laiskodat, Nasdem Party Faction Chairman in the House of Representatives.

According to Director of Public Crimes on National Polices Criminal Investigation Agency, Brigadier General Herry Rudolf Nahak, Victor was on recess when addressing the reported speech.

It has been confirmed during the investigation process, he said.

Bareskrim analyzed that as member of the House, Viktor has Parliamentary immunity

"According to the information, he said it during recess. He had a letter of assignment while carrying out his duties. So he, as member of Parliament, has the rights of immunity as stated in the Act of Parliament. The police do not have the authority to process the case," said Nahak, Tuesday (November 21).

Therefore, the Agency left the case to the Honorary Council (MKD). Nahak said, MKD has the authority in handling cases of its member who is protected by the rights of immunity.

Nahak was reluctant to mention the existence of criminal element in this case. However, if there is a crime, then Viktor remains protected by the right of immunity.

"Crime may exist, but there is a right of immunity that protects him," Nahak said.

Three political parties had reported Viktor Laiskodat regarding alleged hate speech and hostility to the National Police's Criminal Investigation Agency.

The three political parties were Gerindra, PAN, PKS. Then, Democratic Youth Movement also reported him to Bareskrim.

Viktor was reported on allegation of hate speech and hostilities related to his speech in East Nusa Tenggara (NTT) on August 1. Viktor's speech in NTT was viral in cyberspace. 

In the video, Viktor allegedly mentioned there were four parties namely Gerindra, Democrats, PKS, and PAN who allegedly supports the existence of a caliphate for refusing Government Regulation Lieu of Law of mass organizations.

Pretrial

Gerindra Party politician Iwan Sumule said he would file a Pretrial on the suspension of a the Agency's investigation.

"We'll file a pre-trial," Iwan said, Wednesday (November 22).

There was no notice from the investigator about the suspension of the investigation process, so before filing the lawsuit, they will ask for the notice of the development of investigation result (SP2HP) and the letter of suspension of investigation (SP3).

With these two letters, the party will examine the Agency's reason to stop the reports that have been made on August 4. Next, they will take the case to pretrial.
