District court rejects KPK's appeal against cerdict on Gunawan's suit

REPUBLIKA.CO.ID, JAKARTA -- The South Jakarta District Court has rejected the Corruption Eradication Commission's (KPK) appeal against the verdict accepting Commissioner General Budi Gunawan's pretrial suit.

The KPK will discuss the rejection before taking further steps, acting KPK commissioner Johan Budi Sapto Prabowo said here on Monday.

"We have yet to receive a copy of the verdict. After we do, we will bring it up at a meeting between the KPK leadership and the chief of the legal affairs bureau to decide a further course of action with regard to the rejection of the KPK's appeal by the South Jakarta District Court," he stated.

At the final pretrial hearing here last Monday, South Jakarta District Court Judge Sarpin Rizaldi accepted Commissioner General Budi Gunawan's pretrial motion, affirming that the KPK naming Gunawan as a graft suspect was illegitimate.

"The naming of the applicant (Budi Gunawan) as a suspect by the defendant (KPK) was illegitimate and had no legal basis," Judge Rizaldi announced while reading out the ruling.

The judge further remarked that the KPK's letter number 03/01/01/2015 authorizing an investigation into Gunawan's case was illegitimate, as well.

He also rejected all exceptions conveyed by lawyers representing the KPK, who had stressed that Gunawan's pretrial motion was premature and full of contradictions and that the pretrial hearing did not have any authority over the KPK naming him as a suspect.
