REPUBLIKA.CO.ID, JAKARTA — The Commercial Court at the Central Jakarta District Court has ruled in favor of The TIMKEN Company (Timken) in a Trademark Infringement Lawsuit against a company operating in Balikpapan, pursuant to Decision No. 133/Pdt.Sus-HKI/Merek/2025/PN Niaga, issued on April 9, 2026, which has become final and legally binding.

The Commercial Court at the Central Jakarta District Court found that Timken had successfully proven the sale of counterfeit TIMKEN-branded bearings in violation of Article 83 paragraph (1) of Law No. 20 of 2016 on Trademarks and Geographical Indications, and ordered the company to pay damages of IDR 94,611,300.00 to Timken and cease all activities relating to the sale of counterfeit TIMKEN-branded bearing products.

This decision of the Commercial Court at the Central Jakarta District Court highlights the legal consequences of distributing counterfeit products and emphasizes the importance of consumer vigilance in ensuring the authenticity of products available in the market. This decision is expected to strengthen efforts to protect Indonesia’s bearing market from the circulation of counterfeit bearing products that harm consumers as well as legitimate businesses acting in good faith.

Following the Central Jakarta District Court’s decision, Timken urges all end-users and businesses in related industries to remain vigilant and exercise caution regarding counterfeit bearing products or other products bearing the TIMKEN trademark that are being circulated and distributed by unauthorized parties in Indonesia.

“End-users and businesses in Indonesia are advised to purchase TIMKEN-branded bearings only through authorized distributors and to verify the identity of sellers or suppliers of TIMKEN-branded products through Timken’s official website. If they become aware of any suspected circulation of counterfeit TIMKEN-branded bearing products, they are encouraged to promptly report it to Timken’s authorized distributors in Indonesia, together with supporting evidence, so that Timken can take the necessary steps to prevent and address such activities,” said the legal counsel of The TIMKEN Company.
