REPUBLIKA.CO.ID, JAKARTA -- Lawyer Sugito Atmo Pawiro said the police has issue investigation termination warrant (SP3) on alleged Pancasila defamation case involving Head of Islamic Defenders Front (FPI) Habib Rizieq Shihab as suspect in jurisdiction of West Java Provincial Police. He came to National Police Criminal Investigation Unit (Bareskrim) headquarter on Friday to collect his client's belonging that was seized as evidence.
Sugito took back Habib Rizieq' thesis on Pancasila. "The case has been dismissed some time ago with the issuance of SP3," Sugito said at Bareskrim Polri, Jakarta, on Friday.
According to Sugito, the case was dismissed since it did not meet criminal elements. The police have examined some witnesses and expert witnesses on the alleged insult of Pancasila case that was reported by Sukmawati Soekarnoputri.

Police also confirmed the news. "Yes I just confirmed what he said (Sugito)," said Head of Sub-directorat I of State Security, Directorate of Crime General Police Criminal Investigation, Daddy Hartadi.
Meanwhile, Police Director General of West Java Police Commissioner Umar Surya Fana said SP3 of Habib Rizieq's case issued around February to March. Rizieq's case was discontinued due to lack of supporting evidence for processing the case. "Less evidence, no criminal act," he said briefly.
Habib Rizieq was charged under two articles, namely Article 164 on the defamation of a state symbol (Pancasila) and Article 320 of the Penal Code on defamation. As a suspect, Rizieq was not be subjected to detention because both articles' penalty was under five years.
