KPK explain the progress of Sumber Waras case

REPUBLIKA.CO.ID, JAKARTA -- Indonesia’s Corruption Eradication Commission (KPK) haven’t received new evidences from the the Audit Board of the Republic of Indonesia (BPK) related to the purchase of 3.64 hectares Sumber Waras Hospital’s land. “We haven’t met the BPK. Probably, we could meet two weeks to come,” said the Chairman of the Commission, Agus Rahardjo, at the KPK building in Jakarta, Tuesday (12/6). 

On Thursday, (12/1) Agus said that he had been informed about the new facts found by BPK related to the case. But up to now, he has not received the data and information. “We were still waiting for the information from BPK because they said that there were new data and information about the land acquisition, like Cengkareng and Sumber Waras. We want to dig the information out and then we want to get the information from them about the off-budget projects, but the leaders of the institutions have not met yet,” he added. 

The new data would be examined by KPK combined with the previous data. “For example, the off-budgeting discretion was allowed when there weren’t any regulation and when it was urgent. We would see whether the condition was urgent and then was the regulation existed. If, based on the regulation, the Constitution Number 1 about Treasury and Constitution Number 17 about State Finances, we should see it as a whole,” he described. 

On 29 September 2015, KPK issued a warrant for investigation No. 65 in 2015. Together with the audit team of BPK, they seek for data and documents. The team of KPK recommended stopping the investigation, although the audit team of BPK reported that there were state losses of Rp 191 billion. The result was different from the Inspection Report (LHP) of BPK on Jakarta Financial Statement in 2014. It was stated that the indication of state loss was Rp 191,3 billion as the purchasing price was too expensive. 

The different result due to the different regulation used by the BPK auditors and KPK investigators. KPK used the Presidential Regulation No. 40 on the Amendment of Presidential Decree No. 71 of 2012 about the land acquisition for the development of public facilities. On the Article No. 121 stated, the land acquisition for public facilities which the extent were not more than five hectares, could be conducted by the institution which needed the land or by the right holder of land, or by purchasing or exchanging or other ways negotiated by both parties. 

The BPK referred to the purchase price given by PT Ciputra Karya Utama (CKU) to the foundation of Sumber Waras Hospital (YKSW) in 2013, amounted to Rp 564,3 billion. Later, CKU cancelled the land purchasing because it cannot be modified for commercial purposes.
