Prabowo team might seek judicial review in Supreme Court

REPUBLIKA.CO.ID, JAKARTA -- Prabowo Subianto's team is currently preparing to apply for a judicial review in the Supreme Court (MA) regarding some regulations of the General Elections Commission (KPU).

"The Red and White Team's lawyers are still concentrating on applying for a judicial review in MA. In MA, we will not challenge the presidential election's results, but KPU's regulations that we consider are not in line with the existing laws," Didi Supriyanto, a member of the Red and White Advocacy Team, stated here on Friday.

The team will request the court to review four KPU regulations, which are KPU Regulations No. 9, 19, 21, and 31. The regulations concern the additional special voter lists (DPKTb) and the recapitulation process of presidential election's ballots in villages and helmets.

"That is what we are going to do, i.e. filing an application for judicial review in the MA," he remarked.

He explained that the judicial review was not intended to reject the presidential election results or the Constitutional Court's (MK's) verdict on the election dispute.

The judicial review was applied for ensuring a better process of holding the presidential election in the future, he stated.

"One should see the difference between the presidential election process and the results of the presidential election. The MK's verdict is final and binding. We question the presidential election process," he affirmed.

In addition to the judicial review in MA, the advocacy team is also monitoring some cases being handled by the police, he added.

He remarked that his team did not file a lawsuit in the State Administration Court (PTUN), but it was the public that did it.

On August 21, 2014, the MK rejected an attempt by presidential candidate Prabowo Subianto to overturn the election result that he believed was tainted by widespread fraud. The verdict cannot be appealed.

"The court rejects all applications from the applicant by all nine judges," announced MK Chief Hamdan Zoelva at the conclusion of the verdict.
