Public believe in the recovery of Constitutional Court

REPUBLIKA.CO.ID, JAKARTA - Constitutional experts are not afraid of hurricane that struck the Constitutional Court after the arrests of former chairman, Akil Mochtar. They believe that public confidences over the Court will recover.

A survey on 200 experts was conducted in July to October 2013 to know about Constitutional Court's performance in the last 10 years. Survey method used purposive samplings and involved 200 experts as participants who have specific characteristic.

"About 82.1 percent of participants believe that the Court can recover public confidences," SETARA Institute's expert, Ismail Hasani said recently.

To recover public confidences in systematic and sustainable ways, the Court must publish judges' wealth reports transparently. The Court must also thoughtful and careful in doing independent testing of Government Regulation in Lieu of Law (Perppu) No. 1/2013 on Restoration of Constitutional Court.

About 71.8 percent of participants agree that Judicial Commission has an authority to monitor Constitutional Court. However, about 87.2 percent participants said that the return of Judicial Commission's authority was preferably not through a Lieu of Law, but a Law Revision of Constitutional Court.

In this survey, all experts saw that there was a decreased quality since leadership of Jimly Asshiddique to Mahfud MD as chairman of Constitutional Court. It slumped strongly in Akil Mochtar leadership.
