REPUBLIKA.CO.ID, JAKARTA--Former General Manager of US energy giant company, PT Chevron Pacific Indonesia, Bakhtiar Abdul Fatah has been sentenced to two years in prison for illegal use of influence.
Two of three judges in the panel have decided that Fatah was found gulity of corruption charge worth 221,327 USD in bioremediation project in Riau.
"Bakhtiar Abdul Fatah has been found guilty of conduction corruption," Chief Judge Antonius Widijantono said at a sentencing hearing in anti-graft court in Jakarta.
In addition to the prison time, Abdul Fatah would also have to pay fine in the amount of 200 million IDR with subsidiary imprisonment for 3 months in case of insolvency.
Fatah had been accused to violate Article 3 in conjuction with Article 18 of Law on Eradication of Corruption and Article 44 Paragraph 1 of Penal Code (KUHP).
Fatah, according to judges, knew that PT SGJ did not meet requirements of bioremediation project and has no permission to process contaminated and hazardous soil since the license has already expired.
As the companies were still in the process of renewal license, neither did Chevron and PT SGJ have permission from Ministry of Environment and certificate from BP Migas--now SKK Migas (Special Task Force for Upstream Oil and Gas Business Activities). However, Fatah still signed the project agreement on September 1, 2011.
