Tito Karnavian sees two main issues in Viktor's case

REPUBLIKA.CO.ID, JAKARTA - Chief of National's Police, General Tito Karnavian said he has reviewed the case development of alleged hate speech of National Democratic Party politician, Viktor Laiskodat.

Tito ensured the case is still being processed

"Viktor's case has been processed from October. I've checked it directly and the case has been examined. We have also conducted litigation," said Tito at National Police Headquarters, Jakarta, Wednesday (November 29).

He added that more than 30 witnesses, including witnesses of linguists, have also been examined. 

However, he noted there are two main issues that draw the Police concern. The first problem, according to Tito was the language used by Viktor.

"The language is interpretative, let alone using the local language. Some parties felt offended by local language (used by Viktor)," said Tito.

In his speech, Viktor's said some political parties support the caliphate. 

Tito explained, offended parties filed a police report. "It needs technical proof," Tito said.

The second problem, he added, there was a legal issue involving Viktor's position as a member of the Parliament. It was because of the Law of MD3 article 224 paragraph 1 stated every member of the House of Representatives has the rights of immunity. 

So they are free from allegations of legal charges when running their duties.

"The question is, did he said (the offensive statement) in his capacity as House member? If he did, then he was protected by the Parliament immunity," he said.

However, until now the House of Representatives Council (MKD) still has not issued a decision related to Viktor's status. Therefore, the Police have not been able to process the case. 

Police are still waiting for the certainty of MKD in determining whether the remarks Viktor delivered in his duty as a member of the Parliament or not, Tito said.

Viktor was reported on alleged hate speech and hostilities related to his speech in East Nusa Tenggara on 1 August. Viktor's speech in NTT was viral in cyberspace.

In the video, Viktor allegedly accused the four parties, namely Gerindra, Democrat, PKS, and National's Mandate Party support the existence of the chaliphate for refusing Government Regulation Lieu of Law of mass organizations.
