Yusril to revise HTI's application for judicial review

REPUBLIKA.CO.ID, JAKARTA -- Lawyer of Hizbut Tahrir Indonesia (HTI), Yusril Ihza Mahendra, said he will revise the application for judicial review on Regulation in Lieu of Law (Perppu) on mass organizations (Ormas) No.2 of 2017 to Constitutional Court (MK). 

The judicial review previously filed by HTI as organization, will be changed into individuals on behalf of Ismail Yusanto.

On Wednesday, the Constitutional Court held inaugural session of judicial review on Perppu Ormas. During the trial, Yusril asked the constitutional justices about legal standing of HTI.

He explained, when the judicial review filed on July 18, HTI was still a legal entity. A day after, on July 19, the government has officially dissolved HTI.

"We have listened to the advice of the judges because there is very crucial legal issue," Yusril told reporters at the Constitutional Court Building, Central Jakarta, on Wednesday (July 26).

"The applicant of judicial review is Ismail Yusanto as General Secretary and Spokesperson of HTI, who was previously member of the mass organization that was dissolved," he explained.

Yusril asserted, as individuals, Ismail has the right of association which is guaranteed by the 1945 Constitution. In that way, the applicant has a legal standing.

After the inaugural session, Yusril said he would make improvement to the application for judicial review in accordance with the advice of three constitutional judges Arief Hidayat, I Dewa Gede Palaguna and Suhartoyo, during the trial. "We will improve it within 14 days, and God willing, the trial will continue," he added.
