REPUBLIKA.CO.ID, BANDUNG – The defendant of alleged violation to Law on Information and Electronic Transactioin, Buni Yani, denied the indictment made by the prosecutor. He was prosecuted by Article 32 verse 1 juncto Article 48 verse 1 of Law of Information and Electronic Transaction.
The articles ruled the act of changing, adding or reducing information and electronic documentation. Buni Yani said he never been examined by the investigators. “I don't know the Article 32 of Law on ITE as I have never been examined by the investigators,” said him in front of the Chairman of Judges Saptono in Bandung District Court on Tuesday (June 13).
Buni Yani asked it to the panel of judges for several times. But, the panel of judges said the indictment by the prosecutor was an alternative. The defendant might respond to it.
“The prosecutor made the indictment in the alternative form. Your right and the legal council were to respond to that. The obligation of the public prosecutor was to prove the accusation. The prosecutor will present witnesses and evidence. Based on the theory, (a defendant) admitted but might refuse the indictment,” said the Chairman of Judges, M. Saptono.
Buni Yani accompanied by dozens of lawyers. He was insisted to deny the indictment. “I objected as I never had been examined for Article 32 from the file to the end. For Article 32, I objected the indictment. For article 28, from the beginning I was accused for the article. I don't understand,” he said.
Buni Yani's lawyer, Aldwin Rahadian, said Buni Yani was accused to change and edit the video recording of Basuki Tjahaja Purnama (Ahok) remark on Seribu Island. He said it was a lie and baseless. Based on the National Police forensic, the video was not edited. “We would deliver it on the exception,” he said.
At about 10.16 am, the trial was ended. Buni Yani had went to the crowd of demonstrators supported him. He also delivered a short speech.
Meanwhile, the representatives of Islamic mass organization from West Java demanded him to be released. “Free Buni Yani,” said one of them in front of Bandung District
