Miryam S Haryani to stand trial soon

REPUBLIKA.CO.ID, JAKARTA -- The Corruption Eradication Commission (KPK) said Miryam S. Haryani will soon stand trial for allegedly giving false testimony at court.

Miryam has been charged by KPK with giving false testimonywhen sitting at a witness bench in the trial of suspects in an electronic ID (e-ID) card corruption case here earlier.

"The KPK investigators have submitted the dossier and evidence related to the charges against Miryam to the public prosecutor about her false testimony," KPK spokesman Febri Diansyah said here on Wednesday.

Therefore, anything related to the case including any indication of changes in the data or alleged intimidation on Miryam are part of the case that could be opened only at court, Febri said.

"Including recorded results of investigation of Miryam when she was a witness in the e-ID card case," he said.

Febri referred to demand of the Commission III of the House of Representatives to hand over data about legal investigation of Miryam about e-ID card corruption case in which many lawmakers and former lawmakers are implicated.

Miryam, a former lawmaker arrested on allegedly giving false testimony at court, is in the center of conflict between the House and KPK. She hold information about the flow of part of the embezzled money from the e-ID card procurement project to the bank accounts of the lawmakers.

The conflict led to the setting up of the House Special Committee (Pansus) for Inquiry Right on KPK . The conflict began when KPK refused to hand over data about its legal investigation of Miryam related to the alleged flow of the embezzled money to the pockets of lawmakers.

Through the Pansus, the House hopes to force KPK to hand over the data and bring Mariyam to a meeting of the special committee for questioning by the lawmakers.

KPK, however, rejected both requests saying result of legal investigation could be opened only at court. KPK also questioned the legal status the Pansus, which was set up without hearing the opinions of all factions in the House.

In an indictment read out by KPK prosecutor during the trial of suspects in the e-ID card corruption case more than 50 lawmakers and former lawmakers were implicated as having share of the embezzled money of more than Rp2.5 trillion.

The data were based on investigation of Miryam as a witness, but in a trial of suspects, Miryam withdrew all data , saying she was forced to make the statements by KPK investigators.

However, a CCTV video, confirmed by experts, showed no signs of pressure by KPK investigators, leading to her arrest for allegedly giving false testimony.

On the contrary, senior KPK investigator Novel Baswedan said that Miryam had told her investigators that a number of lawmakers had intimidated her seeking to force her not to give fact about the distribution of the embezzled money among the lawmakers.

The lawmakers were members of the Commission III including chairman of the commission Bambang Soesatyo from the Golkar faction, Deputy Chairman of the Commission Desmond Junaidi Mahesa from the Gerindra faction and members of the Commission Sarifuddin Suding, Masinton Pasaribu respectively from the Hanura and PDIP factions.

Earlier, Deputy Chairman of KPK Loade M Syarif said the anti graft agency had no intention of insulting the House by refusing to bring Miryam to a meeting of Pansus.

Laode said KPK wanted to remind the House that summoning a suspect or detainee who is in the process of investigation by KPK could be interpreted as an obstruction of justice.

"Legal process may not be confused with political process," he said.

Based on the Pansus's request, Miryam was to be be present at its meeting last Monday. The Pansus said it would send a second letter asking KPK to bring Miryam to its next meeting or it will use force by police.

However, Police Chief General Tito Karnavian has said police would reject any request by the House Special Committee to bring Miryam from KPK detention to its meeting.

In line with the regulation of the Criminal Law (KUHP), the use of such force was only on order from court, the general said, adding the request of the House to use police force is not clearly mention at the MD3 Law.

He added, however, he would first discuss the legal aspect of the request with the House Commission III and plan to ask interpretation from the Supreme Court.
