REPUBLIKA.CO.ID, JAKARTA -- Religious Affairs Minister Lukman Hakim Saifuddin said Basuki Tjahaja Purnama can not be arrested even though he was named as a suspect of religious blasphemy. According to Lukman, after 1998's reform, the Constitutional Court has reviewed the subversive Act. "Therefore, the law enforcement officers could not act on behalf of the president," he said on Monday at the Coordinating Ministry of Politics' office.

HB Jassin, Permadi and Arswendo Atmowiloto were arrested under the subversive Act. The three were snagged with allegation defamation of religion. Their cases occur in the New Order regime where power was attached to the law.

Therefore, Lukman said the law enforcement officers can not meet people's aspirations to imprison Ahok. Furthermore, the legal proceeding on Ahok is still on process. On Tuesday, Ahok will be questioned as suspect.
