Sentenced to 7 years in prison, OC Kaligis asks for cassation

REPUBLIKA.CO.ID, JAKARTA -- Indonesian senior lawyer Otto Kaligis Kornelis proposed cassation against the decision of the Jakarta High Court which add the sentence to seven years in prison on proven bribery to the judge and the clerk of Medan State Administrative Court (PTUN).

"We have proposed an cassation and already made memory of cassation," Kaligis's lawyer, Humprey Djemat said in Jakarta, Friday (3/6).

It based on appellate decisions Number 14/PID/TPK/2016/PT DKI on April 19, 2016, heavier judicial decisions for first of 5 years and 6 months will be increased to imprisonment for seven years.

"He (OC Kaligis) does not want to receive 5,5 years. We think the verdict of high court is not right. Other party is punished lower than OC, Gerry was just under 5 years," Humphrey added.

He claimed, the thing that can relieve punishment of OC Kaligis is his age now 77 years old.

"As his lawyer, we hope his punishment can be lightened, considering the condition of OC is already 77 years old and the families also feel sad because of OC's penalty, they hope cassation to relieve the punishment," Humphrey said.

At the court of first hearing on December 10, 2015 OC Kaligis sentenced to 5.5 years in prison plus fined amount of Rp 300 million subsidiary 4 months in prison.

While the demands of the public prosecutor of Corruption Eradication Commission (KPK) is 10 years in prison and fine amount Rp 500 million subsidiary 4 months in prison for bribing Tripeni Irianto Putro as the presiding judge of the Medan State Administrative Court (PTUN) as much as 5 thousand Singapore dollars and 15 thousand US dollars, two members of the panel of judges Dermawan Ginting and Amir Fauzi each as much as 5 thousand US dollars as well as the clerk of Medan PTUN Syamsir Yusfan with amount 2 thousand US dollars and total of 27 thousand US dollars and five thousand Singapore dollars.

The money was given to influence a decision on petition for judicial authority of the High Court of North Sumatra on the corruption investigation Social Aid funds (Bansos), the School Operational Assistant (BOS) and Capital Participation in a number of Region Owned Enterprise (BUMD) in North Sumatra Provincial Government so that it complies with the request of Kaligis. The money came from North Sumatra Governor Gatot Pujo Nugroho and his wife Evy Susanti through OC Kaligis's man named Moh Yagari Bhastara Guntur or Gary.
