President decides Antasari’s clemency after Eid

REPUBLIKA.CO.ID, JAKARTA -- President Joko Widodo was still considering granting clemency to former Corruption Eradication Commission (KPK) Chairman, Antasari Azhar. State Secretary Pratikno said, President will decide granting the clemency after the Eid holiday.

Law Number 5 of 2010 on clemency arranged that the president must answer the petition at the latest on 90 days after the clemency filed. According to Pratikno, Jokowi still have enough time to consider the various suggestions related to the clemency for Antasari before the specified deadline.

"There are still about 10 days, almost two weeks," he said, on Tuesday, July 14.

On Monday, July 13, President has summoned a number of officials for advice related to the clemency for Antasari. Law and Human Rights Minister Yasonna Laoly hinted that President Jokowi has agreed to give forgiveness for Antasari. However, there were rules in the Law that blocks the granting of clemency.

"The Supreme Court (MA) give consideration that the period of filing the clemency of Antasari has been passed in accordance with article 7, paragraph 2," he said at the Presidential Palace.

In Article 7, paragraph 2 of Law Number 5 of 2010 on clemency, mentioned that the petition for clemency submitted within one year since obtained the permanent legal force. While Antasari has entered its third year since the clemency petition should be filed.

Yasonna said, on the one hand the President was considering the problems of humanity because Antasari’s condition that was ill at the moment. However, on the other hand the granting of clemency could be rammed the Law.
