Attorney General: No guarantee Budi Gunawan's case will be closed

REPUBLIKA.CO.ID, JAKARTA -- Attorney General HM Prasetyo said he cannot guarantee that the alleged corruption case in which Commissioner General Budi Gunawan was named will be closed after it is referred to his office.

"We must not rush (to conclude that it will be closed). I have not seen the dossiers that the Corruption Eradication Commission (KPK) will be handing over to the Attorney General's Office. In its explanation, the KPK has said that since the police had already handled the same case, the anti-graft body will refer the case to them rather than to the prosecutor's office for more effectiveness," he said during a press conference at the KPK Building here on Monday.

The conference was attended by Coordinating Minister for Political, Security and, Legal Affairs Tjahjo Edi Purdijatno, Minister of Justice and Human Rights Yasonna Laoly, Deputy National Police Chief Commissioner General Badrodin Haiti, and KPK commissioners Taufiqurrahman Ruki, Johan Budi, Indriyanto Seno Adji, Zulkarnai, and Adnan Pandu Praja.

"We'll study the result of the probe. It is impossible to stop the investigation because the prosecutor's office never conducted any investigation into the case, and even if we wish to stop the prosecution, we cannot because we still have not seen the dossiers. So, for effectiveness, I as the attorney general will submit the dossiers at the prosecutor's office to be handed over to the police for proper handling," he added.

The national police's crime investigation department (Bareskrim) that investigated the suspicious transaction case has already given a clean status to Budi Gunawan in the case known so far as the "fat account" case.

The Bareskrim letter dated October 20, 2010, signed by Bareskrim's director of special crimes then Senior Commissioner Arief Sulistyanto, who is now chief of the West Kalimantan police command, stated that no proof could be found to connect Budi Gunawan to the fat account case.

The Bareskrim investigation was carried out based on a report from the Center of Financial Transactions and Analysis (PPATK).

The PPATK had discovered that in 2005, Budi Gunawan's son Hervianto, who was 19 years old, received a loan worth US$5.9 billion (Rp57 billion) in cash from PT Pasific Blue, and he sent Rp35 billion to his father's account.

"We must believe (the decision to refer the case to the AGO). We must not be suspicious. We must respect the principle of presumption of innocence for the sake of the rule of law. We do not like to see such conflicts in the future because only the corrupt benefit from them. A decision should be made so that law enforcement can be ensured with justice, certainty, and benefit," Prasetyo explained.

Commissioner Badrodin Haiti who is now a national police chief candidate noted the police would study the dossiers that the KPK would submit to the prosecutor's office.
