REPUBLIKA.CO.ID, BANDUNG -- The judges Bandung District Court rejected Buni Yani's exception in the alleged hate speech spread through social media. The decision was made at the Arsip Building, Bandung City on Tuesday (July 11).
"The exception can not be accepted, therefore the trial will be proceed with questioning the witnessess," head of the judges's panel M. Sapto said.
Buni Yani’s lawyer Aldwin Rahadian has objected the judge’s interlocutory verdict. However, he has submitted the objection in the principal proceedings of the case. “Our objections will be submitted in the principal hearing,” he said.
One of Buni Yani's objection was the emerge of Article No. 32 verse (1) juncto Article 48 verse (1) Laws No. 19 of 2016 on Electronic Information and Transactions.
"It was never be mentioned during the investigation, then suddenly it emerged in the indictment. They said it these indictment was based on resume," Buni Yani said.
Meanwhile, the judges have granted the defendant request upon the shift of trial schedule. Previously, the trial was held at 09.00 Western Indonesia Standart Time.
“We don’t intend to incriminate the defendant with the trial schedule starting at 09.00 am. Based on various considerations, the next week’s trial will held after the break or around 13.00 pm,” said Sapto.
The judge’s decision to shift the schedule from 09.00 am to 13.00 pm was greeted happily by Buni Yani. According to him, if the trial schedule starts at 09.00, then he must depart from Depok the day before and this is very burdensome in terms of time, cost, energy and mind.
"If the schedule starts at 13.00 pm, I can leave after Dawn prayer, but if it is 09.00 am, I have to stay in Bandung and this incriminates me,” he said.
According to Buni Yani, the transfer of trial from Depok to Bandung is a prosecutor’s tactic to ensnare him. The prosecutor’s scenario for imprisoning him had already begun to appear.
Moreover, this trial was moved from Depok to Bandung. “There is a bad intention from prosecutor on how to get Buni Yani nailed,” he said after the trial.
